MSWiA permit to buy property (zezwolenie MSWiA na zakup nieruchomości)

Consent of the minister responsible for internal affairs (MSWiA) for a foreigner from outside the European Economic Area and Switzerland to acquire real estate — required only in cases specified in the Act on the Acquisition of Real Estate by Foreigners.

Buying a self-contained residential unit, i.e. a flat constituting separate real estate, as a rule does not require a permit. A permit is usually needed to buy land, including a house with a plot, unless an exception under the Act applies, e.g. a sufficiently long stay in Poland on the basis of a permanent residence permit or EU long-term resident permit. The exceptions do not cover all land, e.g. land in the border zone.
